EU Warranty & Conformity Framework

Allyoucanbuy.be acknowledges and applies the statutory obligations regarding consumer goods as established under Belgian legislation (notably Book VI of the Code of Economic Law) and the relevant transpositions of European Union directives, including but not limited to Directive (EU) 2019/771, as amended from time to time.

Scope of Statutory Conformity Rights

The rights of the consumer are limited to those minimum entitlements arising from the statutory conformity regime as transposed into Belgian law. The applicable duration and modalities of such rights correspond strictly to the minimum period and conditions mandated by law in force at the time of purchase.

Such rights extend exclusively to latent non-conformities existing at the moment of delivery which substantially impair the normal use of the product under ordinary domestic conditions. For goods expressly marketed as refurbished, reconditioned or otherwise not sold as new, the applicable protection period shall be restricted to the term expressly communicated at the time of sale and subject to all derogations permitted by law.

Exclusions and Limitations

Without prejudice to mandatory consumer protection rules, the statutory conformity regime shall not extend to, and Allyoucanbuy.be shall bear no liability for, any defect, fault, deterioration, or non-performance arising directly or indirectly from any of the following circumstances, whether individually or in combination:

• ordinary wear and tear, gradual deterioration, loss of performance, cosmetic or aesthetic imperfections, or minor deviations in colour, texture, finish, dimensions, or other product characteristics considered customary in trade;

• negligence, misuse, abnormal, non-domestic, commercial, or industrial use, or failure to observe the product’s user, safety, installation or maintenance instructions;

• improper handling, transport, installation, storage, or cleaning, including use of unsuitable agents or methods;

• accidents, falls, shocks, liquid ingress, humidity, condensation, excessive heat, cold, or other environmental conditions inconsistent with normal household use;

• consumable or perishable elements (including but not limited to batteries, cables, seals, filters, coatings, packaging materials), unless demonstrably defective at the time of delivery;

• alterations, interventions, modifications, software installations, or repairs carried out by unauthorised third parties;

• connection, interoperability, or compatibility issues with ancillary products, accessories, networks or services not supplied or expressly approved by Allyoucanbuy.be;

• defects or performance issues resulting from external causes beyond the reasonable control of Allyoucanbuy.be, including but not limited to incidents of force majeure, voltage fluctuations, power surges, network failures, acts of government, strikes, natural phenomena, or comparable events;

• any case in which the alleged defect cannot be reproduced, is intermittent in nature, or results from factors not attributable exclusively to the original product as delivered.

Any claim falling within the above categories may be declared inadmissible in whole or in part, and any expenses associated with examination, transport, handling, or diagnostics may be recharged to the consumer.

Procedural Requirements

Any invocation of the conformity regime shall only be admissible if all of the following cumulative conditions are satisfied:

1. Formal Notification: The consumer must notify Allyoucanbuy.be formally in writing, without undue delay and within a reasonable period following discovery of the alleged defect. Electronic communications are admissible only if accompanied by all required documentation in durable form.

2. Identification & Documentation: The notification must include:

   • the consumer’s full name and residential address;

   • order confirmation number and purchase date;

   • a copy of the original purchase invoice;

   • official proof of identity (copy of ID card or passport);

   • if requested, proof of residence (e.g. recent utility bill).

3. Substantiation of Defect: The consumer must provide a sufficiently detailed written description of the alleged defect, including the circumstances of discovery, together with supporting material such as high-resolution photographs, video evidence, or equivalent documentation.

4. Return Authorisation: Goods may only be returned following explicit written authorisation from Allyoucanbuy.be. Unauthorised returns may be refused.

5. Return Conditions: Returned goods must be accompanied by all original accessories, documentation, manuals, labels, and packaging, and must be adequately protected for transport. Any further deterioration sustained during transport may render the claim inadmissible.

6. Admissibility: Claims not fulfilling these conditions, incomplete submissions, or notifications outside the time considered reasonable under Belgian law may be rejected without further examination.

Remedies

Upon receipt and verification of an admissible claim, Allyoucanbuy.be shall, in accordance with the remedies foreseen under the statutory conformity regime, elect the measure deemed most appropriate. Depending on the circumstances and within the limits of the law, this may consist of rectification, substitution, proportional price reduction, or restitution.

Where examination determines that no defect of conformity exists within the meaning of the law, all related expenses (including but not limited to transport, handling, testing, and diagnostic costs) may be charged to the consumer.

Governing Law and Jurisdiction

This framework shall be interpreted exclusively under Belgian law and the relevant provisions of European Union legislation, as amended from time to time, without prejudice to any mandatory rights conferred on consumers thereunder.

Any dispute relating to the interpretation or application of this framework shall fall under the exclusive jurisdiction of the courts territorially competent at the registered office of AYCB Group, except where otherwise mandatorily provided by EU consumer jurisdictional rules.
